219 IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH CWP-3396-2021 Date of Decision : 03.04.2025 GURCHARAN SINGH AND OTHERS .....Petitioners VERSUS UNION OF INDIA AND OTHERS .....Respondents
CORAM:
HON'BLE MR. JUSTICE KULDEEP TIWARI Present : Mr. Dhanpat Rai Singla, Advocate for Mr. Inderjit Sharma, Advocate, for the petitioners. Mr. R.Kartikeya, Advocate and Mr. Kartik Patial, Advocate, for respondent no.2. Mr. Sahil R. Bakshi, AAG, Punjab for respondent no.3. Respondent no.1 deleted from the array of respondents.
KULDEEP TIWARI,
J.(Oral)
1. Through the instant writ petition filed under Article 226/227 of the Constitution of India, a prayer is made for issuance of a mandamus upon the respondents to register the petitioners as Registered Medical Practitioner (RMP) doctors in Ayurvedic & Unani System of Medicine, in the State of Punjab.
2. The grievance, as raised through the instant petition is that the petitioners' applications (Annexures P-6 to P-9) for registration has never been decided by respondent no.2, as the same is pending since a long time, and even on their legal notice/representation dated 05.01.2021 DHARAM VIR 2025.04.05 14:53 I attest to the accuracy and integrity of this document
CWP-3396-2021 -2- (Annexure P-11), which the petitioners served through their counsel, no final decision has been take thereon, by respondent no.2. Thus, the lackadaisical and indolent act of respondent no.2, propelled the petitioners to approach this Court through the instant petition.
3.
Learned counsel for contesting respondent no.2 fairly submits that he does not have any objection in case the the instant petition is disposed of with a mandamus upon respondent no.2, to decide the legal notice/ representation (supra), in a time bound manner.
4. In view of the above, the instant petition is disposed of with a mandamus upon respondent no.2 to decide the legal notice/ representation (supra), by passing a speaking order within a period of 04 weeks from the date of receipt of a certified copy of this order.
