Oriental Insurance Company Ltd. vs. Anil Kumar and others FAO No.292 of 2024 19.09.2025 Present: Mr. Deepak Bhasin, Senior Advocate with Ms. Shruti Dubey, Advocate, for the appellant. Mr. Yudhbir Singh Thakur, Advocate, for respondent No.1/ complainant. Ms. Sunita Sharma, Senior Advocate with Ms. Sugandh Verma, Advocate, for respondents No.2 and 3. Mr. Jagan Nath, Advocate, for respondent No.4. CMP No.17904 of 2025 Heard learned counsel for the parties and perused the pleadings. On account of injuries, the claimant in the case at hand, i.e., respondent No.1 had been awarded an amount of Rs.10,55,760/- along-with 12% interest from 04.06.2015 (one month after the date of accident) till deposit. Taking into account the age of the applicant, the fact that the applicant works as a labourer with Contractors in order to eke-out his livelihood, the fact that in the accident, he had sustained injuries, precarious financial condition highlighted in the application and the fact that certain repair work needs to be carried out insofar as his house is concerned, I deem it appropriate to order release of 50% of the awarded amount along-with up-to-date interest accrued thereupon. The amount be remitted to his bank account, detailed in Paragraph-3 of the application, subject to proper verification. The application stands disposed of. ( Bipin C.
