ORAL ORDER
Accused No.5 in Crime No.689/2024 registered by Bellanduru Police Station, Bengaluru City, for offences punishable under Sections 103, 61, 189(2), 190, 191(2), 191(3), 238, 239, 240 of the Bharatiya Nyaya Sanhita, 2023 (for short, 'BNS') is before this Court under Section 483 of the Bharatiya Nagarik Suraksha Sanhita (for short 'BNSS') seeking regular bail.
2. Heard learned counsels for the parties.
3. FIR in Crime No.689/2024 was registered by Bellanduru Police Station, Bengaluru City, against unknown persons initially for offence punishable under Sections 103 of BNS-2023 on the basis of the first information dated 14.10.2024 received from Smt.Nagaratna, wife of the deceased - Tippesha.
4. During the course of investigation of the case, petitioner herein was arrested on 19.10.2024 and subsequently, remanded to judicial custody. Investigation of the case is completed and the charge sheet has been filed against five persons and the petitioner is arrayed as accused

No.5 in the charge sheet. Bail application filed by the petitioner in Crl.Mis.No.874/2025 before the Jurisdictional Sessions Court was rejected on 18.02.2025. Therefore, the petitioner is before this Court.

Learned counsel for the petitioner submits that allegation against accused No.3 and the petitioner herein is similar in the charge sheet. Petitioner has no criminal antecedents. Accused No.3 has been granted regular bail by this Court in Crl.P.No.2510/2025. Accordingly, he prays to allow the petition.
6. Per contra, learned Additional SPP who has opposed the petition, does not dispute the submission made by the
learned counsel for the petitioner.
7. Perusal of the materials on record would go to show that allegation as against the petitioner herein and accused No.3 is similar in the chare sheet. It is not in dispute that the petitioner has no other criminal antecedents. He is in custody from 19.10.2024. Accused No.3 as against whom similar charges are found in the charge sheet and who was arrested along with the petitioner on 19.10.2024 has been granted regular bail by this Court in Crl.P.No.2510/2025. Considering

the aforesaid aspects of the matter, I am of the opinion that the prayer made by the petitioner for grant of regular bail is required to be answered affirmatively, on the ground of parity. Accordingly, the following:-
ORDER The petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.689/2024 registered by Bellanduru Police Station, Bengaluru City, for offences punishable under Sections 103, 61, 189(2), 190, 191(2), 191(3), 238, 239, 240 of BNS, subject to the following conditions: a) Petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses;

d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
