From perusal of the averments made in the FIR per which a cognizable offence is made out, it is legally not possible to quash the FIR keeping in view the law laid down by Apex Court in the case of Niharika Infrastructure Private Limited vs. State of Maharashtra - 2021 (19) SCC 401. Accordingly, the writ petition is dismissed leaving it open to the petitioner to pursue other remedy as may be available to him under law. October 31, 2025 A.
