Page No.# 2/3 By this application, the petitioner has prayed for pre arrest bail in connection with Dalgaon P.S Case No. 133/2025 registered under Section 406/409/420 of the IPC. The FIR dated 12.08.2025 reveals that the petitioner who was the i/c Secretary of Silbori Gaon Panchayat has transferred huge amount of money from the 15th Finance Commission Mother Account to his own account and also to the account of his relatives and has allegedly misappropriated more than crores of rupees. It is also stated in the FIR that the Block Development Office, Dalgaon Sialmari Development Block had reported the matter to the CEO, Darrang Zila Parishad and constituted an Enquiry Committee and asked the petitioner to report before the same but the petitioner did not appear before the said Enquiry Committee. Mr. Alom, learned counsel submits that the petitioner was simply an i/c Secretary of Silbori Gaon Panchayat and that he was not involved in transferring the money from the Mother Account to his account more so on the ground that both the President and the Secretary can jointly operate the said account. Ms. N. Das, learned Addl. Public Prosecutor however submits on the basis of the Case Diary that the bank officials have given statement and in their statement, they have implicated the petitioner to have transferred money to his own account. Page No.# 3/3 On the basis of the submissions made by the parties and materials available in the Case Diary, this Court does not deem it fit to release the petitioner on pre arrest bail.
