This is first bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant in Crime No.1/2025 registered at Police Station Benur, District Narayanpur, Chhattisgarh for the offences under Section 137, 64 of the BNS and sections 4 & 6 of the POCSO Act. 2. The prosecution version is that the victim has lodged complaint against the present applicant alleging that he committed forceful sexual intercourse with her, on the basis of which, FIR was filed. Learned counsel for the applicant submits that the prosecutrix was major, her age was not proved and she was a consenting party. He further submits that out of total 18 prosecution witnesses, only 3 have been examined and there is no immediate possibility of disposal of trial. He submits that the applicant is in jail since 22.02.2025 and looking to his period of custody, he may be enlarged on bail. 4. Per contra, learned State Counsel opposes the bail application and submits that at the time of incident, the victim girl was minor. 5. The victim girl along with father has appeared through VC from concerned DLSA and objected to bail. 6. Having considered the submissions made by the learned counsel for the parties and the material placed before me and after perusal of the trial Court order and the case diary, I do not feel it appropriate to release the applicant on regular bail.
