Respondent/s BEFORE HON’BLE MR. JUSTICE A. GUNESHWAR SHARMA Order 25.08.2025 [1] This matter is taken up as unlisted item on mention in supplementary. [2] Heard Mrs. Th. Babita, learned counsel for the petitioner, Mr. Y. Ashang, learned G.A. assisted by Mr. Robert, learned counsel for the State respondent and Ms. L. Kamei, learned counsel for the Union of India. [3] The petitioner earlier approached this Court by way of WP(C) No. 620 of 2025 for allowing him to mark the option for applying in Management Seat in SAHS. Due to miscommunication, he could not tick the relevant portion even though he has already ticked for Government Seat in RIMS, JNIMS and CMC. [4] Vide order dated 12.08.2025, this Court allowed the petitioner to be considered for Management Seat under SAHS and observed in para 16 of the order dated 12.08.2025 that the admission of the petitioner in Management Seat should be done in terms of the prescribed procedure. Thereafter, the Director of Health Services, Manipur issued a notification dated 22.08.2025 releasing the names of 78 candidates for admission in Management Quota for MBBS in SAHS and it was mentioned in para 3 of the notification dated 22.08.2025 that one seat under Management Quota for MBBS at SAHS has been kept on hold and will be allotted subject to the outcome of the pending case i.e. WP(C) No. 620 of 2025. [5] Mrs. Th. Babita, learned counsel for the petitioner, submits that the petitioner has not been allotted any seat in SAHS Management Quota on the mistaken presumption that WP(C) No. 620 of 2025 is still pending before this Court. She clarifies that WP(C) No. 620 of 2025 and connected applications have been disposed of by this Court vide order dated 12.08.2025 directing the respondents to consider the case of the petitioner for admission in Management Quota at SAHS as per prescribed procedure. [6] Learned counsel for the petitioner draws the attention of this Court to the lists of merit lists candidates recommended for Management Seat in SAHS on merit list. She has pointed out that as per NEET (UG) 2025 result, the petitioner scored 447 marks and the person at serial No. 3 in SAHS Management Quota has NEET score of 436. As such, the petitioner should have been recommended at serial No. 3 with the mark of 447 in the Management Quota in SAHS. In the circumstances, it is prayed that writ petition may be disposed of by directing the respondents, especially Director of Health Services, Government of Manipur, to allot one seat kept reserved to the petitioner, as he is otherwise eligible on merit. [7] Mr. Y. Ashang, learned G.A., fairly concedes that WP(C) No. 620 of 2025 has already been disposed of by this Court on 12.08.2025 and in this circumstances, this Court may pass appropriate order in the peculiar facts of the case. [8] Ms. L. Kamei, learned counsel, also adopts the submission of Mr. Y. Ashang, learned G.A. for the State respondent. [9] This Court has perused the materials on record and considered the submission made at the bar. [10] While disposing WP(C) No. 620 of 2025 vide order dated 12.08.2025, this Court directed the respondents to consider the case of the petitioner for admission in the Management Quota in SAHS, if he is otherwise eligible as per prescribed procedure. From the notification dated 22.08.2025, the candidate at serial No. 3 recommended by the State for admission in Management Quota in SAHS has NEET score of 436 which is lower than the petitioner. This shows that the petitioner is eligible for consideration against the Management Quota in SAHS. [11] Since one seat has already been kept reserved in terms of the notification dated 22.08.2025, writ petition is disposed of by directing the respondents to allot the seat reserved to the petitioner. [12] With this observation, writ petition is disposed of. [13] Furnish a copy of this order to the learned counsel appearing for the parties during the course of the day through whatsapp/e-mail.
