In Re: - An application for anticipatory bail under Section 438 of the Code of Criminal Procedure corresponding to Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with English Bazar P.S. Case No.108 of 2017 dated 07.02.2017 under Sections 448/325/326/307/34 of the Indian Penal Code read with Sections 3/4 of the Explosive Substance Act. And
In the matter of: Sanju Ghosh @ Sanjit Ghosh
….Petitioner. Mr. Parvej Anam
…for the petitioner. Mr. Kaushik Biswas Ms. Diksha Ghosh
…..for State
Learned counsel appearing on behalf of the petitioner submits as follows. There was a free fight between the two groups of people. There is no specific allegation against the present petitioner.
Learned counsel appearing on behalf of the State relies on the injury report of a victim, the seizure list and statements of injured witnesses as well as the independent witnesses and submits that there is a strong case made out against the present petitioner. Even the independent witnesses had taken his name as one of the main accused and the victim suffered bomb blast injury.
In view of the material available in the case diary, I am not inclined to grant anticipatory bail to the present petitioner.
Accordingly, the application for anticipatory bail is rejected.
