Heard learned counsel for petitioner and learned State counsel for opposite parties no.1 & 2. 2. Learned State counsel has been provided written instructions dated 11.11.2025, a copy of which is taken on record and as per which opposite party no.3 has already been intimated with regard to pendency of this petition. However opposite party no.3 i.e. Dr. Suman Yadav, the said person has not yet put in appearance but service is deemed upon opposite party no.3. 3. The present petition has been filed challenging order dated 17.09.2025 to the extent it transfers opposite party no.3 to the Government Girls High School, Tarauli, Mubarakpur, Ambedkar to Government Girls High School, Badepur, Jalalpur District Ambedkarnagar. Further prayer has been made to consider petitioner for posting as Principal/ Headmistress in the Government Girl High School, Badepur, Jalalpur, District Ambedkar. 4. Learned State counsel submits that petitioner's posting has been effected in the Government High School NEWADA in District Jaunpur in pursuance of her promotion and is not in fact effected as a mode of transfer. Learned counsel for petitioner however submits that due to family problems being faced by her, it is essential that she remains posted in Ambedkar Nagar. 6. Since redressal of petitioner’s grievance would entail discretion be exercised by the executive authority, liberty is granted to make fresh representation to opposite party no.2 i.e. Director, Secondary Education U.P. Prayagraj or any other competent authority who may consider and decide the same expeditiously within a period of three weeks from the date a certified copy of this order is produced before the said authority. Continuance of petitioner at the place of posting shall be subject to final order passed by the authority. 7. With the aforesaid directions, the writ petition stands disposed of.
