Heard Mr. M. Biswas, the learned counsel appearing for the petitioner. Also heard Mr. K. Jain, the learned Standing Counsel, NCB.
2. This is an application under Section 483 of the BNSS, 2023 in respect of NDPS Case
Page No.# 2/2 No.73/2022 (corresponding to NCB Crime No.28/2021) pending in the court of learned Addl. Sessions Judge No.5, Kamrup(M) at Guwahati.
3. On an earlier occasion, a bail application was filed and on that day i.e. 29.05.2025, this Court directed that out of total 8 (eight) witnesses, two of whom are already examined and two of whom were to be examined and after that the petitioner was given liberty to approach this Court seeking bail.
4. Mr. Biswas has submitted that after examination of 2(two) witnesses, another witness was partly examined and there is no guarantee when the other witness will be examined.
5. After considering the submissions made by the learned counsel of both sides, this Court has decided to stick to the view taken on 29.05.2025.
6. Let the trial court examine 2(two) witnesses as directed earlier. After examination of the remaining two witnesses, the petitioner shall have the liberty to approach this Court again. With the aforesaid direction, the present Bail Application stands closed and disposed of.
