Since the investigation of Hatishala PS Case No. 79 dated 12.04.2025 is in progress and the writ petition encloses a medical document issued by a diagnostic centre and polyclinic dated 20.03.2025 as ‘Spondylotic lipping seen in C4-C6. Disc space between C4-C5 and C6-C7 reduced.’ In view of the observations of the diagnostic centre the investigating authorities would revisit regarding the applicability of section 118(2) of the BNS in the backgrounds of the facts of the case. With the aforesaid observations WPA 7870 of 2025 is disposed of.
