Vashishtha, Advocate ---- 7/06.08.2025 Heard the learned counsel for the petitioner as well as the learned counsel for the respondent State. 2. The petitioner is apprehending his arrest in connection with Dumka (T) P.S. Case No.11 of 2023, for the offence registered under sections 420/34 of the IPC and Section 20 of the Prevention of Corruption Act, 1988, pending in the court of learned Additional Sessions Judge-II-Cum-Spl.Judge (ACB), Dumka. 3. Learned counsel for the petitioner submits that the petitioner has not received any illegal gratification from any teacher or staff. He submits that the Deputy Commissioner, Dumka has constituted enquiry committee in light of the Annexure-2 and the enquiry committee has submitted its report. He submits that the allegation has been denied by the petitioner of taking Rs.5000/-from one of the teachers, however, on force, admission has been made of receiving the same and the signature has been made. He submits that in identical situation the co-accused have been granted anticipatory bail by the coordinate Bench of this Court in A.B.A. No.5595 of 2023 as well as A.B.A. No.7138 of 2023. 4. Learned counsel for the respondent-ACB has opposed the prayer and submits that the demand of Rs.5000/- has been found by the enquiry committee. 5. Considering that in identical situation, two of the co-accused have been granted anticipatory bail in the aforesaid ABAs, I am inclined to grant anticipatory bail to the petitioner. 6. Accordingly, the petitioner, above named, is hereby directed to surrender before the learned court within three weeks from today, and in the event of his surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-II-Cum-Spl. Judge (ACB), Dumka, in connection with Dumka (T) P.S. Case No.11 of 2023, subject to the conditions as laid down under section 482(2) of the Bhartiya Nagrik Suraksha Sanhita (BNSS).
