By means of present revision, the revisionist has challenged the order dated 03.11.2025 passed by the learned Additional Principal Judge, Ist, Family Court, Barabanki (in short 'Family Court') in Misc. Case No. 644 of 2022. Vide impugned order dated 03.11.2025 the Family Court rejected the application filed by the petitioner which was preferred with the prayer to summon the statement of Account related to Phone Pay of Mobile No. 9305057005 which belongs to the opposite party No.2/Smt. Vandana Sharma. Relevant portion of the impugned order dated 03.11.2025 reads as under:- "पśावली के अवलोकन से दिशत होता है िक Šĥतुत Šकरण माननीय उċच ęयायालय इलाहाबाद, DZारा एĆशन Ěलान से अċछािदत Šाचीनतम Šकरणȋ मȅ से एक है एवं बहस के ĥतर पर है। बहस के ĥतर पर सĞपूणă साĨय होने के उपराęत िवपWी DZारा Šाथăना ब-51/1 Šĥतुत करते ɷए आवेिदका के मोबाइल नं० 9305057005 से जुíे पंजाब नेशनल बȈक के खाते का ĥटेटमȅट, उǘ नं० से जुíे फोन-पे वैलेट का ĥटेटमȅट व वािदनी मुकदमा वęदना शमाă DZारा 2008 से अब तक खरीदे गये वकालतनामȋ का िववरण सĞबिęधत बȈक व िजला बार एसोिशएसन बाराबंकी से तलब िकये जाने के िनवेदन िकया गया है। Šकरण मȅ उभयपW का साĨय पूणă हो चुका है। सुĥथािपत िविध है िक कोई भी पWकार अपने अिभकथनȋ से परे जाकर साĨय Šĥतुत नहȂ कर सकता न ही ऐसे िकसी साĨय को ęयायालय के माĘयम से तलब कराने का िनवेदन ही कर सकता है, िजसका कोई उġलेख उसके जवाबदावे/आपिǥ मȅ नहȂ है। िवपWी के जवाबदावे मȅ आवेिदका को अिधवǘा सहायक बताया गया है न िक ĥवयं अिधवǘा। जवाबदावे मȅ इस बावत् भी कोई उġलेख नहȂ है िक आवेिदका का कोई बȈक खाता पंजाब नेशनल बȈक मȅ है, वह फोन-पे के माĘयम से या अिधवǘा Dzवसाय से वह आय करती है। ऐसी दशा मȅ जबिक िवपWी की ओर से ऐसा कोई अिभकथन जवाबदावे मȅ नहȂ है, Šाथăना पś ब-51/1 Versus Counsel for Revisionist(s) : Upendra Prakash Pathak Counsel for Opposite Party(s) : G.A. Home, Lko And Another .....Opposite Party(s) ţामक व एĆशन Ěलान से सĞबिęधत Šकरण को िवलिĞबत करने के आशय से Šĥतुत िकया जाना पाते ɷए िनरĥत िकये जानȅ योĈय है।" It is to be noted that opposite party No.2/Smt. Vandana Sharma instituted a proceedings in terms of Section 125 CrPC, registered as Misc. Case No. 644 of 2022 in which aforesaid application bearing No. Ba-51/1 was preferred upon which the impugned order dated 03.11.2025 has been passed. To impeach the findings based upon written statement according to which the Family Court observed that a party can be permitted to adduce its evidence only in connection to the pleadings and the revisionist has not brought copy of the written statement before this Court and it is nothing but concealment of material available on record. Upon due consideration of aforesaid facts of the case as also the submissions advanced by the parties, this Court finds no force in the revision. It is accordingly dismissed.
