HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. BAIL APPLICATION No. - 11704 of 2025 Court No. - 15 HON'BLE KARUNESH SINGH PAWAR, J. Heard learned counsel for the applicant, learned AGA for the State and perused the record. Learned counsel for the applicant submits that although one recovery has been shown, three separate cases have been registered on its basis, which the applicant has duly explained in paragraph 21 of the bail application. It is further pointed out that co-accused Diwakar Mishra, Bablu Lona, and Budhu Prasad have already been granted bail by the learned trial court, and copies of their bail orders have been filed as Annexures 6 and 6A to the application. It is further contended that the alleged recovery of two yellow chains, three rings, one pair of bali, and a silver kardhan is wholly false and fabricated. There is no independent witness to support the purported recovery, and the applicant has no prior criminal antecedents. It is further submitted that there is no possibility of the applicant of fleeing away after being released from jail or tampering with the witnesses. In case the applicant is enlarged on bail, he shall not misuse the liberty of bail. Learned A.G.A. opposed the prayer for bail but could not dispute the aforesaid facts as argued by the learned counsel for the applicant. Having considered the overall facts, including that the applicant is in custody since 13.09.2025, the charge-sheet has already been submitted, and the Versus Counsel for Applicant(s) : Prem Prakash Singh, Javed Khan Counsel for Opposite Party(s) : G.A. Raja @ Raj .....Applicant(s) State Of U.P. Thru. Addl. Chief Secy. Home Deppt. Lko. .....Opposite Party(s) offences are triable by a Magistrate, I am of the view that the applicant has made out a fit case for grant of bail. Accordingly, the bail application is allowed. Let the applicant Raja @ Raj, involved in Case Crime No.- 391/2025, U/S- 305, 331(4), 324(4), 317(2) of BNS, Police Station-Jalalpur, District- Ambedkarnagar, be released on bail in the aforementioned case on furnishing a personal bond and two sureties each in the like amount to the satisfaction of Magistrate/Court concerned, subject to following conditions:- (i) the applicant shall not tamper with the prosecution evidence; (ii) the applicant shall not pressurize the prosecution witnesses; (iii) the applicant shall appear on each and every date fixed by the trial Court. Any other condition(s) which the trial court/concerned court may deem fit and proper, in the circumstances of the case, may also be imposed. It is clarified that the observations made in this order are confined to the present bail application and shall have no bearing on the merits of the trial. December 11, 2025 R.C.
