Heard learned counsel for petitioner and learned State Counsel for opposite parties. 2. Petition has been filed mainly for the following reliefs:- "A. Issue a writ, order or direction in the nature of Mandamus commanding the opposite parties to grant 3rd Time Scale/3rd ACP in the Grade Pay of Rs.7600/- to the petitioner upon the completion of 26 years of satisfactory service with effect from the due date. B. Issue writ, order or direction in the nature of Mandamus commanding the opposite parties to accordingly revise the pension of the petitioner as per the grade pay fof Rs.7600/- as well as grant arrears of the same with interest." 3. Since considering petitioner's grievance would entail factual aspects, liberty is granted to petitioner to file fresh representation before opposite party no.1 i.e. State of U.P. through Principal Secretary, Public Works Department, Anubhag - 4, Civil Secretariat, Lucknow - or any other competent authority who shall consider and decide the same, in case same benefit has already been accorded to person junior to petitioner, within a period of eight weeks from the date of receipt of fresh representation along with a certified copy of this order. 4. With aforesaid direction(s), the petition is finally disposed of.
