Heard learned counsel for the applicants, learned A.G.A. for the State and perused the record. 2. This application has been filed for quashing the order dated 28.04.2023 passed by Sub Divisional Magistrate, Tehsil Musafirkhana, District Amethi in Case No.3716 of 2022 (State vs. Jagdish and others) under Section 133 Cr.P.C. 3. Learned counsel for the applicants submitted that all the encroachment which was allegedly made by the applicants has already been removed. Learned counsel for the applicants submitted that the order passed by the learned court below under Section 133 Cr.P.C. has already been complied with letter and spirit and he does not want to pursue the present petition, accordingly, the same may be dismissed as infructuous by allowing the application for withdrawal. 4. As the applicants do not want to press the petition and considering the statement that the order of learned Magistrate under Section 133 Cr.P.C. has already been complied with, accordingly, the application is hereby, dismissed on the ground that the order in question has already been complied with.
