HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. BAIL APPLICATION No. - 8253 of 2025 Court No. - 12 HON'BLE PANKAJ BHATIA, J.
1. Heard learned counsel for the applicant, learned AGA and perused the record.
2. The accused-applicant seeks bail in FIR/Case Crime No.239 of 2018 under section 304, 452, 34 IPC, P.S. Malhipur, District Shrawasti.
3. The contention of the counsel for the applicant is that although the applicant was named in the FIR, however, no charge-sheet was filed against the applicant. Subsequently, the charge-sheet was filed against the co- accused Noor Mohammad as well as the applicant in the year 2025. It is further argued that the co-accused against whom the charge-sheet was filed along with the applicant has been enlarged on bail vide order dated 21.08.2025 passed in Bail Application No.7804 of 2025.
4. As the allegation and the material against the applicant is similar to the co-accused Noor Mohammad and the applicant has no criminal antecedents, the applicant who is in custody since 30.06.2025 is entitled to bail. Thus the bail application is allowed.
5. Let the applicant Shekhawat Sai @ Umar Mohd Sai be released on bail in aforesaid FIR/Case Crime Number subject to his furnishing a personal bond and two reliable sureties of Rs.20,000/- (Twenty Thousand) each of the like amount to the satisfaction of the court concerned with the following conditions: Versus Counsel for Applicant(s) : Manoj Kumar Singh, Neelam Mishra, Sharvan Kumar Pandey Counsel for Opposite Party(s) : G.A.
