HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW HABEAS CORPUS WRIT PETITION No. - 400 of 2025 Court No. - 13 HON'BLE SAURABH LAVANIA, J. Heard learned counsel for the petitioner, learned A.G.A. for the State and perused the record. This Habeas Corpus petition has been filed seeking following main relief(s) :- "i. Issue a writ, order or direction, in the nature of Habeas Corpus against the opposite party no. 02 and 03 commanding them to produce the corpus from the illegal custody of the respondent No. 05 and handover her custody to the guardian/mother or set her free at her liberty." Considered the facts of the case including the statement of the alleged detenue annexed as Annexure No.2, dated 22.09.2025, which is extracted herein under:- "मȈ िशखा िसह पुśी ũी िवनोद िसह पता अनौरा कला िचनहट लखनऊ थाना बी०बी०डी० लखनऊ के िनवासी ɸं। मेरे जęम ितिथः 15.09.2006 है। मȈ बािलक ɸं। और अपनी मजȃ से अपने दोĥत अमरनाथ िसह (चंदन) पुś योगेęŝ िसह िनवासी पताः- बनकट थाना गíहनी िजला भोजपुर (आरा) िबहार का िनवासी है, के साथ रह रही ɸं। मेरे साथ िकसी Šकार का कोई जबरदĥती नहȂ िकया जा रहा है। मȈ अपनी ĥवतंś से इनके साथ खुश ɸं।" Upon due consideration of the aforesaid, this court finds that the alleged detenue with her own volition is living with opposite party No.5-Amarnath Singh @ Chandan, S/o Yogendra Singh, resident of Village- Bankar, P.S.-Gadhani, District - Bhojpur Ara, State of Bihar. In view of the aforesaid, this Court finds no force in the petition. It is accordingly dismissed.
