Heard Shri Sudhir Kumar Pandey, the learned counsel for the petitioner. 2. Keeping in view the nature of relief sought and the order proposed to be passed, issuance of notice to the respondents is dispensed with. 3. By means of the instant petition, the petitioner has sought issuance of a direction to the learned Civil Judge, Junior Divsion, Tanda, Ambedkar Nagar for expeditious disposal of restoration Application dated 11.01.2023 for recall of the order dated 23.12.2022, bearing Civil Misc. Application No.09/2023 in re: Original Suit No.423 of 2001. 4. A perusal of the copy of the order sheet of the trial Court indicates that various dates have been fixed since 11.01.2023 and the matter has repetitively been adjourned for one reason or the other. The petitioner is a 72 years old person. 5. Keeping in view the aforesaid facts, the present petition is disposed off by issuing a direction to the learned Civil Judge, Junior Divsion, Tanda, Ambedkar Nagar to decide petitioner's restoration Application dated 11.01.2023 for recall of the order dated 23.12.2022, bearing Civil Misc. Application No.09/2023 in re: Original Suit No.423 of 2001 expeditiously, by fixing dates at short intervals, without granting any unnecessary adjournment to any of the parties.
