Tahla, Tehsil Rajgarh, District Alwar ----Respondents For Petitioner(s) : Mr. Chandra Prakash Saini For Respondent(s) : Mr. Shree Ram Dhakar, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 16/07/2025
1. The present criminal misc. petition has been preferred by the petitioner under Section 528 of BNSS for quashing the Sessions Case No.30/2005 dated 24.02.2007, whereby, the respondent Nos. 2 and 3 were acquitted under Section 307 of IPC by the learned Additional Session Judge, Rajgarh.
2. Heard and perused the material available on record.
3. The deposition of injured witness PW-6 Manphool, was disbelieved by the learned Trial Court as the other witnesses did not corroborate the fact that the respondent deliberately hit the petitioner with the motorcycle. Further, the report was lodged with an inadequate delay. The prosecution story remained unproved, as
[2025:RJ-JP:26624] (2 of 2) [CRLR-303/2007] the other eye witness PW-2 Khairati Lal in his examination-in-chief has clearly stated that PW-6 Manphool did not utter a single word to the fact that he was hit by motorcycle rather he disclosed that he was under intoxication and was hit by some unknown vehicle. Similarly, the other witness PW-3 Ravi Kumar, PW-4 Ramdhan and PW-5 Ghanti Meena have also not supported the prosecution story and were declared hostile.
4. The learned Trial Court after discussing the statement of all the material witness concluded that there is no iota of evidence available on record indicating the fact that the respondents deliberately hit the injured Manphool in order to cause his death.
5. Therefore, considering the above facts, I do not find any illegality or perversity in the findings arrived at by the learned Trial Court. Accordingly, this criminal revision petition is devoid of any merits and is hereby dismissed.
