HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CONTEMPT APPLICATION (CIVIL) No. - 229 of 2025 Court No. - 8 HON'BLE MANISH KUMAR, J. Respondent has filed compliance affidavit which is taken on record. Learned counsel for the applicant has submitted that the gratuity and provident fund has not been paid to the applicant. In reply, learned counsel for the respondent has drawn the attention of this Court to Annexure no. 3 to the compliance affidavit where the gratuity and provident fund has also been paid to the applicant. Learned counsel for the applicant again raised an objection and has submitted that the interest has not been paid to the applicant on delayed payment, as directed by the writ Court. For the said submission of learned counsel for the applicant, it is found that there was no positive direction for payment of interest on the delayed payment. For payment of post retiral dues, the applicant was directed to make a representation and the authorities were directed to decide the same and in case, the applicant was found to be entitled for the aforesaid benefit, the actual payment thereof shall be made within a period of six weeks and thereafter, an observation was made by the writ Court which was regarding payment of interest but it was not a positive direction, i.e. "The concerned authority shall also take decision with regard to awarding its delayed payments". Hence, the judgment and order passed by the writ Court has been complied with. In view of above, the present contempt application is dismissed as infructuous. Notice, if any, stands discharged.
