The petitioner has moved this petition against the order dated 10.02.2025 passed by learned Judicial Magistrate First Class, Bilaspur, District Bilaspur (C.G.) in N.I.A. Case Digitally signed by HEERA LAL SAHU Date: 2025.08.20 18:12:44 +0530 2 No. 157/2017 whereby the learned Judge has acquitted the respondent from the charge under Section 138 of Negotiable Instrument Act. 2. At the outset, learned counsel for the petitioner submits that in view of the judgment dated 08.04.2025 rendered by the Hon’ble Supreme Court in the matter of Celestium Financial vs. A. Gnanasekaran Etc., 2025 INSC 804, he seeks permission of this Court to withdraw this petition with liberty to file an appeal under the proviso of Section 372 of Cr.P.C within a period of 30 days from this order before appropriate forum. He also submits that the certified copy of the impugned order may be returned to him. 3. Prayer is allowed. 4. Accordingly, this petition is dismissed as withdrawn with the aforesaid liberty.
