Abbasi, learned counsel for the petitioner. Also heard Mr. P. Borthakur, learned Additional Public Prosecutor. 2. This petition under Section 483 of the BNSS, 2023 has been filed by the accused-petitioner, namely, Bhabesh Singh, who is stated to be in custody since 01.08.2025 and praying for grant of bail in connection with Dispur P.S. Case No.622/2025 under Sections 303(2) of BNS. Page No.# 2/2 3. The FIR dated 24.07.2025 was lodged by the owner of one motor cycle bearing Registration No. AS01GA4425, which was stated to have been stolen when it was parked near a market. 4. Mr. P. Borthakur, learned Additional Public Prosecutor has produced the case diary and submits that two other bikes were recovered upon showing by the present accused and that the FIR mentioned bike is not recovered. However, he fairly submits that no other case details have been mentioned in this regard, vis-à-vis the accused. 5. I have perused the case diary along with the statement of the accused. IO has contended that the accused is habitual offender. 6. In view of continuance of the investigation and the points contended by the IO – in which I find sufficient force, from the materials revealed by investigation – I am of the view that bail at this stage to this accused might prejudice the investigative efforts. 7. Accordingly, the bail application stands rejected at this stage and disposed of. 8. Return the case diary. JUDGE Comparing Assistant
