Per contra, learned AGA opposed the prayer for bail and submitted that due to rash and negligent driving of the applicant two children died but could not dispute the fact that due as per statement of Ritik, who was sitting in the car along with applicant, suddenly at the time of driving a cow came in front of the vehicle due to which incident occurred. He further could not dispute the fact that applicant is not having any criminal history and he is in jail in the present matter since 05.11.2024. 7. I have heard learned counsel for the parties and perused the record of the case. 8. Further, even after perusal of statements of other witnesses recorded during investigation, at this stage, it cannot be said that it is not a case of accidental death. 10. Further, applicant is not having any criminal history and he is in jail in the present matter since 05.11.2024. 11. Therefore, considering the facts and circumstances of the case discussed above, in my view applicant is entitled to be released on bail. 12. Accordingly, without expressing any opinion on the merits of the case, the instant bail application is allowed. 13.
