Present petition under Article 226 of Constitution of India has been filed challenging order dated 17.09.2025 whereby petitioner employed on the post of Village Development Officer has been attached with the office of District Panchayat Raj Officer, Balrampur. 3. It has been submitted that a bare perusal of impugned order will make it evident that it has been passed on an ex parte basis and on stigmatic grounds of being absent during the Zero-Poverty Camp. 4. It is submitted that admittedly a show cause notice was served upon petitioner on 10.09.2025 requiring petitioner to submit his reply within three days but even prior thereto, a report was submitted on the very next day on 11.09.2025 and impugned order has thereafter been passed on 17.09.2025. 5. Learned counsel for petitioner has drawn attention to various annexures to the petition to submit that petitioner has relevant G.P.S. photographs as well as other evidence to prove that he was very much present during the camp and therefore the impugned order has been passed without considering such facts. 6. Learned State Counsel has been provided written instructions dated 25.10.2025, a copy of which is taken on record and submits that initial show cause notice was issued to petitioner on 01.09.2025 but the petitioner kept avoiding receipt of the said notice which was also served upon him through WhatsApp. Ultimately, the notice was served upon petitioner on 10.09.2025. It is submitted that impugned order has been passed on the basis of reports by the officials concerned clearly indicating petitioner's absence during camp activities. 7. Upon consideration of submissions advanced by learned counsel for the parties and perusal of material on record, it is evident that the show cause notice was served upon petitioner on 10.09.2025 and the report in pursuance thereof was submitted on 11.09.2025, i.e. the very next day.
Evidently, ample opportunity for submitting reply has not been provided to petitioner. It is also evident that the impugned order has been passed on stigmatic grounds. 8. In view thereof, impugned order dated 17.09.2025 is hereby quashed by issuance of a writ in the nature of Certiorari granting liberty to opposite parties to pass orders afresh after affording opportunity of hearing to petitioner and considering his reply. Liberty is also granted to him to furnish all evidences available with him to corroborate his presence at the Camp.
