HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW WRIT - C No. - 11277 of 2025 Court No. - 3 HON'BLE SHEKHAR B. SARAF, J. HON'BLE BRIJ RAJ SINGH, J. 1. Heard learned counsel appearing on behalf of the parties and perused the material on record. 2. The petitioner alleges that the private respondent-Bank has taken possession of his vehicle by using illegal means. 3. Upon perusal of the writ petition, we are of the view that the writ petitioner has admitted that he had not paid the dues of the Bank, and accordingly, the Bank has acted as per the agreement and repossessed the vehicle. The petitioner has a remedy by way of filing a suit and/or an application under Section 9 of the Arbitration and Conciliation Act, 1996. 4. Since, such an alternative remedy is available, we are of the view that this Court should not exercise its discretionary power. 5. Accordingly, the writ petition is disposed of with liberty granted to the petitioner to approach the appropriate court for redressal of his grievances.
