HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC ANTICIPATORY BAIL APPLICATION U/S 438 CR.P.C. No. - 603 of 2025 Court No. - 15 HON'BLE KARUNESH SINGH PAWAR, J. The present anticipatory bail application has been filed seeking anticipatory bail in Complaint Case no.12050 of 2022, under Sections 323, 504, 506, 379, 436, 452 I.P.C., P.S. Jalalpur, District Ambedkar Nagar. Heard learned counsel for the applicant as well as learned AGA for the State. Perused the record. From a perusal of the record, it is evident that the applicant was granted interim anticipatory bail vide order dated 29.05.2025, subject to certain conditions, including the furnishing of bail bonds and appearance before the trial court. Upon a specific query being put by the Court, learned counsel for the applicant fairly submitted that the applicant could not furnish the requisite bail bonds before the trial court as he is residing abroad. A careful examination of the record, coupled with the aforesaid submission, clearly demonstrates that the applicant has failed to comply with the conditions imposed under the interim anticipatory bail order. The address disclosed in the memo of the bail application, i.e. ‘House No. 16, SPG 41- 39, KG Kiarong, Brunei Darussalam, Bandar Seri Begawan, BE 1318 BN’, further indicates that the applicant is residing outside the country and has not appeared before the trial court even on a single occasion. Anticipatory bail is a discretionary relief, which is granted subject to strict Versus Counsel for Applicant(s) : P.K. Mishra, Tarun Mishra Counsel for Opposite Party(s) : G.A., Rehan Ahmad Siddiqui Mohammad Ibrahim .....Applicant(s) State Of U.P. Thru. Prin. Secy. Home Lko. .....Opposite Party(s)
compliance with the conditions imposed by the Court. The conduct of the applicant in not complying with the conditions of the interim anticipatory bail order, coupled with his continued absence from the jurisdiction of the trial court, reflects a clear disregard for the judicial process and raises a reasonable apprehension regarding his availability for investigation and trial. In view of the aforesaid facts and circumstances, this Court is of the considered opinion that the applicant has not made out a case for continuation or confirmation of anticipatory bail. Accordingly, the anticipatory bail application is dismissed. December 15, 2025 R.C.
