Heard Shri Aditya Tiwari, learned counsel for the petitioners, Shri Dheeraj Ojha, learned Standing Counsel appearing for the State and Shri Mohan Singh, learned counsel for the private-respondents. 2. By means of the present petition filed in the public interest, the petitioners have sought issuance of direction for removal of encroachment made on five lands, situated at Village- Bharkhari, Tehsil- Lambhua, District- Sultanpur. 3. On the basis of written instruction, learned Standing Counsel has informed that encroachment has been found only on one of the five lands bearing Gata No.176 measuring 0.076 hectares, registered as Rasta in the revenue record and the proceeding under Section 67 of UP Revenue Code has already been instituted for removal of encroachment over the said land. 4. In view of the above, the present petition stands disposed of by issuing a direction to the respondent no.3- Sub-Divisional Magistrate, Tehsil- Lambhua, District Sultanpur to conclude the proceeding initiated under Section 67 of UP Revenue Code expeditiously in accordance with law, after giving reasonable opportunity of hearing to the affected persons.
