No.618 of 2025.
2. All these three cases are relating to the same accused. The cases in C.C.Nos.1082, 1083 and 1084 of 2024 was taken on the file of the Judicial Magistrate No.2, Erode Taluk, Erode for the alleged offence under Section 379 of I.P.C. The accused committed theft of complainant's money. It is reported that the property involved in this case has been recovered and returned to the complainant and the de-facto complainant has no objection for closing the case. It can been seen that the split up case in S.C.No.297 of 2023 was proceeded further and the accused was convicted and subsequently released. Suo Motu TR.Nos.16174, 16199 and 16266 of 2025 de-facto complainant does not want to proceed the case further. 3.Considering the factual matrix, context of the case, the reason for absence from his usual place, and the submission that, despite best efforts, the warrant could not be executed, it is evident that even if the accused is brought to face trial, it would impinge upon his right to a speedy trial. Due to the passage of time, a meaningful trial is unlikely, and no useful purpose would be served. 4.Accordingly, the case in C.C.Nos.1082, 1083 and 1084 of 2024 of Judicial Magistrate No.2, Erode Taluk, Erode, stands quashed. These Suo Motu Transfer Cases are disposed of. 10.10.2025 mp Note to the Trial Court: This order is digitally signed and communicated electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed /
disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
