Heard Mr. N. Uddin, learned counsel appearing for the petitioner. Also heard Mr. R. Kaushik, learned Addl. Public Prosecutor for the State. By this application the petitioner has prayed for bail in connection with Patacharkuchi P.S. Case No. 161/2025 registered under Section
Page No.# 2/3 64/296/351(2)/79/3(5) of BNS. The FIR dated 08.08.2025 reveals that the informant was in relationship with the petitioner and that marriage has also been proposed between them. The victim also alleged that the petitioner on the pretext of the said proposal entered into physical relationship with her and that later on, the father of the petitioner arranged the marriage of the petitioner with some other girl and that the father of the petitioner misbehaved with the victim. Mr. N. Uddin, learned counsel for the petitioner submits that there was a relationship between the petitioner and the victim and there was also a talk of marriage between them. However, he submits that later on some developments took place but he submits that there was no physical relationship between the petitioner and the victim as stated in the FIR. Mr. R. Kaushik, learned Addl. Public Prosecutor by relying on the case diary submits that the relationship between the victim and the petitioner was writ large in the materials more so in the statement of the victim. The victim have also stated in her statement that she went with the petitioner to various places in view of the relationship between them and that later on the petitioner refused to marry her. In view of the said submissions and in view of the statement of the victim recorded under Section 183 of the BNSS, this Court finds it fit that the petitioner
Page No.# 3/3 may be released on bail on furnishing a bail bond of Rs.
20,000/- (Rupees twenty thousand) with one (1) local surety of the like amount to the satisfaction of CJM, Bajali, Pathsala under the following conditions:- 1) The petitioner shall co-operate with the investigation and shall appear before the CJM, Bajali, Pathsala as and when called for. 2) The petitioner shall not tamper with the evidence or influence the witnesses. 3) The petitioner shall not leave the jurisdiction of the CJM, Bajali, Pathsala without the permission of the said Court.
