Order 04/07/2025
1. Petitioners have filed the instant criminal miscellaneous petition under Section 528 B.N.S.S. with a prayer to quash and set aside the FIR No. 248/2024 registered with Police Station Malakhera, District Alwar for the offence under Sections 143, 332 & 353 of IPC and Section 3(2) (va) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989.
2.
Learned counsel for the petitioners submits that the petitioners have falsely been implicated in the FIR, whereas they were not at all present at the time of incident.
[2025:RJ-JP:24710] (2 of 2) [CRLMP-2900/2025]
3. Learned Public Prosecutor has opposed the prayer and raised contention that as to whether the petitioners were available at site of the incident or not, is a matter of investigation and only on that ground quashing of FIR cannot be sought more particularly when investigation is still pending.
4. I have heard the contentions of the learned counsel for the parties and examined the record.
5. In the facts and circumstances of the case it would be in the interest of justice to direct the petitioners to make a representation highlighting all the facts which have been mentioned in the instant petition. In case, any representation is made then Investigation Officer is directed to take the facts into
consideration and to proceed further strictly in accordance with law.
6. In the light of above directions, the criminal miscellaneous petitioner shall stand disposed of.
7. All pending applications as well as stay application shall also stand disposed of.
