Sarma, learned counsel for the petitioner and Mr. A. Ganguly, learned Standing counsel, Bank of India for the respondents. 2. By way of the present writ petition, the petitioner is assailing the order dated 11.10.2023 whereby the petitioner was put under suspension and he also prayed for payment of arrear salary as well as subsistence allowance as due payable to him w.e.f. 11.10.2023. 3. Mr. Sarma, learned counsel for the petitioner submits that during the pendency of this writ petition, subsistence allowance has already been paid to the petitioner and the suspension order dated 11.10.2023 has also been revoked by order dated 18.10.2024. 4. In view of the aforesaid, nothing survives to be adjudicated in this petition as regards the payment of subsistence allowance and revocation of the suspension order dated 11.10.2023, however, the payer for payment of arrear salary still remains. 5. Accordingly, this writ petition stands closed with a liberty to the petitioner to file a representation before the competent authority seeking arrear salary and the respondent authority shall consider the same as per law. 6. Such exercise be carried out by the competent authority within a period of Page No.# 3/3 6 (six) weeks from the date of receipt of a certified copy of this order along with a copy of the representation of the petitioner. In the event, if it is find that the petitioner is entitled for such salary, the same may be paid to him within 6 (six) weeks thereafter. JUDGE Comparing Assistant
