HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. ANTICIPATORY BAIL APPLICATION U/S 482 BNSS No. - 1673 of 2025 Court No. - 15 HON'BLE KARUNESH SINGH PAWAR, J. Heard learned counsel for the applicant as well as learned Additional Government Advocate for State. The present application has been filed seeking anticipatory bail in case crime No. 286 of 2025 under Section 305 A, 317(2), 331(4) BNS, 2023, Police Station Padua, District Lakhimpur Kheri. Submission of learned counsel for the applicant is that the applicant is innocent and has been falsely implicated in the present case. It is submitted that the name of the applicant has surfaced only in the confessional statements of the co-accused persons. Learned A.G.A., on the other hand, has opposed the prayer for anticipatory bail and submitted that the applicant has a chequered criminal history of twelve cases, out of which three cases are of a similar nature. It is contended that the applicant is a habitual offender and, therefore, no case for grant of anticipatory bail is made out. The investigation in the matter is still in progress. At this stage, learned counsel for the applicant submits that he does not wish to press the present anticipatory bail application and prays that liberty may be granted to the applicant to file a regular bail application, which may be considered in the light of the judgment of the Hon'ble Supreme Court in Satender Kumar Antil vs. Central Bureau of Investigation and another, Special Leave to Appeal (Cri.)
