The instant petition has been filed praying for a mandamus commanding the respondents to conduct fair and proper investigation by some other Investigating Officer in Case Crime No.0271 of 2025, under Sections 85, 80(2) of B.N.S., 2023 and Sections 3/4 of Dowry Prohibition Act, Police Station Mallawan, District Hardoi. 5. This Court, vide order dated 10.10.2025 had required the S.H.O. to file his personal affidavit and in pursuance thereof, the personal affidavit of the S.H.O., Police Station Mallwan, District Hardoi has been filed today by the learned A.G.A., which is taken on record. 6. Learned A.G.A. states on the basis of averments contained in the personal affidavit that (a) the charge sheet dated 30.10.2025 has been submitted before the supervisory authority against five accused persons; (b) the accused Shvi Pratap Singh has been arrested on 31.07.2025 and (c) for the other accused, the Court in Writ Petition No.8295 (M/B) of 2025, vide order dated 16.09.2025 has stayed the arrest of the other accused.
