HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. ANTICIPATORY BAIL APPLICATION U/S 482 BNSS No. - 1633 of 2025 Court No. - 15 HON'BLE KARUNESH SINGH PAWAR, J. Heard learned counsel for the applicant as well as learned AGA for the State. The present application for anticipatory bail has been filed for protection in regard to Case Crime No.324/2025, Under Sections: 115(2), 109, 352, 126 (2) 352 BNS, Police Station- Kadipur, District - Sultanpur. Notice to respondent no. 2 is dispensed with in view of the proposed order. In the prosecution case, it is alleged that on 16.06.2025, the informant and his friend Ranjeet Nishad were returning from Sultanpur on a motorcycle when, near Jalalpur Brick Field, four accused persons named in the FIR intercepted them. It is alleged that one of them, Ratnesh, was exhorted to fire, upon which Ratnesh Shukla shot and injured Ranjeet Nishad. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated. It is further submitted that no offence under Section 109 of the Bharatiya Nyaya Sanhita is made out against him. Learned A.G.A., on the other hand, has opposed the prayer for anticipatory bail and, by referring to the case diary, submits that the injured has attributed the act of firing to the accused persons. Although the injured has not named any particular accused in his statement, he has stated that one among the four accused persons fired at him, and thus, it cannot be said to be a case of false Versus Counsel for Applicant(s) : Ranjeet Pratap Singh Counsel for Opposite Party(s) : G.A. Dalsingar Singh .....Applicant(s) State Of U.P. Thru. Prin. Secy. Deptt. Of Home Lko. And Another .....Opposite Party(s) implication. The injury report shows that the injury sustained by the victim is on his leg. It is further submitted that no case for grant of anticipatory bail is made out, as the applicant has a criminal history of nine cases, including offences under Sections 302, 307, and 394 IPC, among others. Upon due consideration of the statement of the injured, the injury report, and the applicant’s chequered criminal history comprising nine cases, including some of serious nature, I do not find it a fit case for grant of anticipatory bail. Accordingly, the application for anticipatory bail stands rejected. November 4, 2025 R.C. NABAIL No. 1633 of 2025 2 (Karunesh Singh Pawar,J.)
