RAMACHANDRA RAO Order 21/11/2025 This application had been filed under Section 24 of the CPC for transfer of case No.T.S.(Nullity) 01 of 2024 pending before the Family Court, Udaipur, Gomati District to the Family Court, Dharmanagar, North Tripura. It is contended by the petitioner that she is residing at Damchara, North Tripura and the case is pending at Udaipur, Gomati District which is about 150 Kms. and it would be difficult for her to attend the proceedings in the Family Court, Udaipur, Gomati District. Though notice was sent to the respondent, it had been returned unserved. Notice was also sought to be sent to the counsel appearing for the respondent in the Family Court, Udaipur, Gomati District but it has been returned with endorsement that the counsel reported that he had no contact with the respondent and he is refusing to accept the notice. I may point out that the address to which the notice had been issued to the respondent is the very address given by the respondent in the case T.S.(Nullity) No.01 of 2024. It is surprising that the notice sent by this Court came back unserved. It is clear that the respondent is trying to evade service of notice. Therefore, this application is allowed, since the respondent has not disputed the contentions of the petitioner and T.S.(Nullity) No.01 of 2024 on the file of Family Court, Udaipur, Gomati District is transferred to the Family Court, Dharmanagar, North Tripura.
