JUSTICE A. GUNESHWAR SHARMA O R D E R 02-09-2025 [1] Present Mr. H.S. Paonam, learned senior counsel assisted by Mr. N. Bipin, learned counsel for the petitioner. [2] Service of the sole respondent had been served by dasti service on 25-08-2025. However, when the matters are taken up today, none appears on behalf of the respondent. [3] In the present petition, the Account No. 50200041022071 of the petitioner opened with HDFC Bank, Yairipok Branch had been frozen on the basis of illegal transaction deposit made in his account. However, as per the information supplied by the Bank, no amount online financial had been deposited in the account of the petitioner and it is submitted that there is no justification in the letter dated 08-08-2025 issued by the respondent-Bank to the petitioner that his account had been marked “No Debit” under compulsion of law. WP(C) No. 642 of 2025 & MC(WP(C)) No. 598 of 2025 [4] Mr. H.S. Paonam, learned senior counsel for the petitioner, refers to the order dated 27-08-2025 passed by this Court in WP(C) No. 493 of 2025 where the bank account of the petitioner therein was defroze as no amount from the online fraud was deposited in the said account. It is submitted that similar order may be passed in the present case. [5] This Court has considered the material on record and as per the information given by the respondent-bank to the petitioner, there is no mention of any amount deposited in the account of the petitioner. This Court is of the view that keeping the petitioner’s account in the category of “No Debit” is not justifiable in the present case. Accordingly, it is directed that the bank account of the petitioner opened with HDFC Bank, Yairipok Branch be operationalized. [6] With this observation, the writ petition is disposed of.
