GP FOR HOME 3 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 16649 of 2020 ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “…pleased to issue a writ, order or direction more particularly one in nature of Writ of Mandamus declaring the high handed action on the part of the respondent No.3, 5 and 6 in pressurizing me to get settle the issue with the respondent No.8 under the guise of investigation in Cr.No.382 of 2020 on the file of Old Guntur Police Station, Guntur, Guntur District even though there are civil disputes are pending consideration before the competent civil court apart from N.I.Act cases and conducting biased and table investigation at the instance of the respondent No.6 as arbitrary, illegal, colorable exercise of power and violate the fundamental rights guaranteed to me under Articles 14, 19 and 21 of the Constitution of India and consequently direct the respondents No. 3, 5 and 6 not to pressurize me to get settle the civil dispute with the respondent No.8 and also direct the respondent No.2 to supervise the investigation in Cr.No.382 of 2020 on the file of the Old Guntur Police Station, Guntur, Guntur District and pass.…” 2. None represented for the petitioner. 3. When the matter was taken up for hearing, Sri V.Farooq, learned Assistant Government Pleader for Home, on written instructions, would submit that a case was registered against the petitioner in Crime No.382 of 2020 for the offences punishable under Sections 420 and 324 r/w 34 of IPC on 02.09.2020. He would further submit that on 07.09.2020, the Investigating Officer served notice on the petitioner under Section 41-A of Cr.P.C., and instructed the petitioner to submit his proofs as to his presence at the time of 4 the alleged incident. The petitioner came to the police station on 09.09.2020, but could not submit any proofs in that regard. Learned Assistant Government Pleader would further submit that the police never pressurized the petitioner to settle the civil issue with the 8th respondent. 4. Recording the above said submissions, the Writ Petition is disposed of. There shall be no order as to costs.
