JUSTICE A. GUNESHWAR SHARMA O R D E R 22-08-2025 [1] Heard Mr. A. Golly, learned counsel for the petitioner and Mr. H. Debendra, learned Dy. Advocate General assisted by Mr. L. Somorendro Roy, learned junior Government counsel on behalf of the State respondents. [2] The petitioner approached this Court apprehending that he may be evicted and his structure be demolished on his patta land covered by Patta No. 466/1114, C.S. Dag No. 1263/1682, Village No. 27-Wangkhei Nongpok, Imphal East District. It is submitted that the petitioner is the owner of the said land by way of registered gift deed from his father and his name is recorded in the relevant revenue record after due verification and he has started construction upon the land after due permission from IMC and PDA. It is stated that on 18-08-2025 and 20-08-2025, the staff of the Revenue Department visited his residence and informed that the petitioner had encroached some portion of Government land and would demolish the same. [3] On the other hand, Mr. H. Debendra, learned Dy. Advocate General for the State respondents, submits that at the present, the State Government is undertaking a mass drive for eviction of encroachment upon Government land and in this process, no one has been evicted from the patta land and no demolition is done within the patta land and the eviction and demolition, if any, are on the encroached portion of the Government land. [4] This Court is of the opinion that the apprehension of the petitioner has been taken care by fair submission of Mr. H. Debendra, learned Dy. Advocate General and the writ petition is disposed of with the following observation that:— There should be no eviction within the patta land of the petitioner and no structure of the petitioner within the patta land be demolished. Eviction, if any, upon the encroached portion of the Government land be done land after due process of law. [5] With this observation, the writ petition is disposed of. MC(WP(C)) No. 600 of 2025 is also closed. [6] Furnish a copy of this order to the learned counsel appearing for the parties in the course of the day. JUDGE Victoria
