HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW WRIT - C No. - 11946 of 2025 Court No. - 3 HON'BLE SHEKHAR B. SARAF, J.
HON'BLE MANJIVE SHUKLA, J.
1. Heard Sri Harsh Pratap Singh, Advocate holding brief of Sri Ajeet Kumar Singh, learned counsel appearing on behalf of the petitioner and learned Standing Counsel appearing on behalf of the State.
2. This is a writ petition under Article 226 of the Constitution of India, wherein the writ petitioner has made the following main prayer:-
"i) issue a writ, order of direction in the nature of Mandamus to direct the opposite parties to allow the petitioner to open/run the shop situated at retail buffalo meat shop at Khurmuli, Pihani Dehat, P.S. Pihani, District Hardoi which is closed by the opposite party no.4 (Station House Officer P.S. Pihani, District Hardoi) since JULY 2025."
3. Learned counsel appearing on behalf of the State submits that he has instructions that the Station House Officer is not interfering in any manner in running of the meat shop.
4. We are not convinced with the said submission made by the learned counsel appearing on behalf of the State as it appears that in several cases, a similar pattern is there, wherein the police authorities are not allowing persons, who have been allotted a license to run these kind of meat shops all over the State.
5. In light of the same, we direct the Superintendent of Police, Hardoi to look into this matter and ensure that the petitioner is allowed to run Versus Counsel for Petitioner(s) : Ajeet Kumar Singh Counsel for Respondent(s) : C.S.C. Asad .....Petitioner(s) State Of U.P. Thru. Prin. Secy. Home And 3 Others .....Respondent(s)
his meat shop unless there is any other impediment in law.
6. With the above direction, the writ petition is disposed of. December 17, 2025 cks/- WRIC No. 11946 of 2025 2 (Manjive Shukla,J.) (Shekhar B. Saraf,J.) Digitally signed by :- CHANDRA KANT SINGH High Court of Judicature at Allahabad, Lucknow Bench
