Heard Shri Rajendra Prasad, learned counsel for the applicants, Shri S.K. Tiwari, learned A.G.A. for the State and perused the record. The instant application under Section 482 Cr.P.C. has been filed seeking following main relief(s) :- "Wherefore, it is most respectfully prayed that this Hon'ble Court may kindly be pleased to quash the summoning order dated 02.06.2022 passed by learned Additional Chief Judicial Magistrate 1st, Court No. 25, Lucknow in Criminal case no. 53776 of 2022; State versus Raju Pal and others, related to crime No. 112 of 2021 under section 498A, 323 I.P.C. Police Station Kaiserbagh, Lucknow contained in Annexure no.3 as well charge sheet filed by the police against the petitioners contained in Annexure no.2, on the basis of compromise, contained in Annexure No.5, to this petition in the interest of justice." On account of some formal defects crept in the application, learned counsel for the applicants prays for withdrawal of the application with liberty to the applicants to file afresh with proper pleadings and documents in support thereof. The aforesaid has not been opposed. In view of the above, the instant application is dismissed as withdrawn with liberty as prayed for. Office is directed to return certified/original copies of the documents annexed with the application to the learned counsel for the applicants as per rules.
