HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. ANTICIPATORY BAIL APPLICATION U/S 482 BNSS No. - 1776 of 2025 Court No. - 15 HON'BLE KARUNESH SINGH PAWAR, J. The present anticipatory bail application has been filed seeking anticipatory bail in case crime No.748 of 2024 under sections 406, 506, 420 I.P.C., P.S. Kotwali Nagar, district Sultanpur. Heard learned counsel for the applicant and learned A.G.A. for the State. As per the prosecution case, it is alleged that the accused persons received a sum of Rs. 8 lakhs from the informant for the purpose of executing a sale deed for a plot. However, despite receiving the entire sale consideration, the sale deed was not executed. When the informant demanded the return of her money, three cheques belonging to the account of co-accused Ranveer Singh Rajput were issued to her. It is further alleged that upon presentation of the first cheque, the same was dishonoured by the bank with the remark that payment had been stopped by the account holder. Submission of learned counsel for the applicant is that the offences alleged are triable by the Magistrate. He further states that the applicant has duly explained the criminal antecedents relating to the three cases in the supplementary affidavit. It is also pointed out that co-accused Durga Vati Singh has already been granted anticipatory bail by this Court vide order dated 23.09.2025 in Criminal Misc. Anticipatory Bail Application under Section 482 No. 1265 of 2025, wherein detailed observations have been made. Versus Counsel for Applicant(s) : Anuj Kumar Mishra, Ram Kalesh Counsel for Opposite Party(s) : G.A. Ranvir Singh Rajpoot .....Applicant(s) State Of U.P. Thru. Prin. Secy. Home Lko .....Opposite Party(s) It is additionally contended that since the charge sheet has already been submitted, no useful purpose would be served by taking the applicant into custody. Learned counsel assures that in the event of being granted anticipatory bail, the applicant shall strictly comply with all conditions imposed by the Court, fully cooperate in the investigation, and shall not misuse the liberty so granted. Learned A.G.A. has opposed the prayer for anticipatory bail; however, he does not dispute the fact that the charge sheet has been filed. Considering the fact that the charge sheet has been submitted, the FIR was lodged after an unexplained delay of more than two years, offences are triable by magistrate, and having regard to the undertaking furnished on behalf of the applicant to cooperate with the investigation, this Court is of the considered view that the applicant is entitled to the benefit of anticipatory bail. Accordingly, in light of the judgment of the Hon’ble Supreme Court in Musheer Alam v. State of U.P., 2025 SCC OnLine SC 116, the applicant is granted anticipatory bail, subject to his cooperation in the investigation. In view of the above, it is provided that in the event of arrest, the applicant shall be released on anticipatory bail in the aforesaid Case Crime number on his furnishing a personal bond with two sureties each in the like amount to the satisfaction of the arresting officer/investigating officer/S.H.O. concerned with the following conditions:- The applicant shall report to the investigating officer within twenty days from today.
