Since, the matter is being decided at the admission stage, therefore, notice to opposite party no. 5 is hereby dispensed with. Heard learned counsel for the petitioners, Dr. Udaiveer Singh, learned counsel for the opposite parties no. 1 to 4 and perused the records. Present writ petition has been filed with the following main reliefs :- "1) Issue a writ of mandamus or a writ, order or direction in the nature of mandamus commanding the opposite party number 2 to take a decision on the recommendation dated 03.02.2024 sent by the opposite party number 3 for providing arrears of salary to the petitioner for the period from 16.12.2021 to 09.11.2023 in accordance with law; (II) Issue a writ of mandamus or a writ, order or direction in the nature of mandamus commanding the opposite parties, particularly opposite party numbers 2 and 3 to pay arrears of salary to the petitioner for the period from 16.12.2021 to 09.11:2023 within a period as stipulated by this Hon'ble Court;" It is submitted by the learned counsel for the petitioners that the instructions have been sought by the District Inspector of Schools from the Director vide letter dated 03-02-2024, which is still pending consideration before him and no direction has been given. He further submitted that the interest of justice would be sub-served if this Hon'ble Court may be pleased to direct the opposite party no. 2/Director of Secondary Education, Lucknow to take a decision in furtherance of the letter dated 03-02-2024. Learned counsels for the opposite parties have no objection to the contentions aforesaid. Be that as it may, without entering into the merits of the case, the opposite party no. 2/Director of Secondary Education, Lucknow, is Versus Counsel for Petitioner(s) : Pawan Kumar Pandey, Vittan Counsel for Respondent(s) : C.S.C. Brijendra Kumar Singh And Another .....Petitioner(s) State Of U.P. Thru. Prin. Secy. Deptt. Of Secondary Edu. Lko And 4 Others .....Respondent(s) directed to take a decision on the letter dated 03-02-2024 within the period of three weeks from the date a certified copy of this order is produced before him.
