HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW APPLICATION U/S 482 No. - 7716 of 2019 Court No. - 29 HON'BLE MANOJ BAJAJ, J. Applicant-Accused has approached this Court through this application under Section 482 Code of Criminal Procedure, to challenge the order dated 27.08.2019 passed by revisional court, whereby the order dated 28.05.2019 dismissing his application for discharge passed by Additional Chief Judicial Magistrate CBI (A.P.), Lucknow, in Case No.05 of 2018, arising out of Case Crime No.102 of 2017, under Sections 354/354- A/354-B/506 I.P.C., registered at Police Station Aashiyana, district Lucknow, has been upheld. None for the applicant. Learned A.G.A. is present. On 01.11.2019, learned counsel for the applicant was granted time to file supplementary affidavit placing on record the relevant documents and the same was filed on 19.11.2019. However, there is no interim stay in favour of the applicant, much less to stay the proceedings before the trial court. Applicant-accused has pleaded that the complainant, who is his younger brother's wife has falsely implicated him in the case, because of her matrimonial dispute, and also the statements of the complainant recorded under Sections 161 Cr.P.C. and 164 Cr.P.C. are at variance. As per the grounds raised, the charge sheet against the applicant could not have been Versus Counsel for Applicant(s) : Rakesh Kumar Agrawal, Kunwar Ravi Prakash, Saksham Agrawal Counsel for Opposite Party(s) : G.A., Gyan Singh Shyam Manohar Tripathi .....Applicant(s) State Of U.P. And Anr. .....Opposite Party(s)
filed, therefore, being aggrieved against the same, the applicant has approached this Court for quashing of the criminal proceedings, as his application seeking discharge already stands dismissed through the impugned order dated 27.08.2019. Application has been pending for the last six years and by now, the trial must have progressed, therefore, the alleged cause of action seemingly is rendered infructuous. The petition is dismissed.
