Khan, learned counsel appearing for the accused petitioner as well as Mr. P. Borthakur, learned Addl. P.P., Assam appearing for the State respondent. 2. This petition under Section 483 of the BNSS, 2023 has been filed by the accused- petitioner, namely, Biswajit Mondal praying for grant of bail in connection with Bongaigaon PS Case No. 177/2025 under Sections 103(1) BNS. 3. The allegation in the FIR dated 07.07.2025 is about cause of assault on the victim and Page No.# 2/2 subsequently, he succumbed to death. 4. It is submitted by the learned counsel for the petitioner that both the accused and the informant are from West Bengal and working as labourers and prior to the instant incident, they might have consumed liquor. 5. Case diary has been received. Post mortem indicate head injury. 6. Learned Additional Public Prosecutor has submitted that eye witnesses also implicated the accused. I have seen the progress of investigation which appears to be substantially progressed but not yet completed. The accused is stated to be pre trial detention for 78 days. 7. In the given circumstances, it is provided that the accused petitioner, named above, shall be released on bail of Rs.25,000/- with one suitable surety (preferable local) of the like amount to the satisfaction of learned concerned court, subject to the following conditions that the petitioner: (a) shall render co-operation to the remaining investigation.
