Heard Mr. N. N. Jha, learned counsel appearing for the accused petitioner as well as Mr. D. P. Goswami, learned Addl. P.P., Assam appearing for the State respondent. 2. This petition under Section 483 of the BNSS, 2023 has been filed by the accused-petitioner, namely, Farhad Ali, who is stated to have been arrested on Page No.# 2/2 01.07.2025 and praying for grant of bail in connection with Patacharkuchi P.S. Case No.130/2025 under Sections 296 /351(2)/109 of the BNS Act. 3. The allegation in the FIR dated 30.06.2025 is about attempting to kill the informant with sharp iron pipe but that somehow he managed to save his life. 4. Learned counsel for the petitioner submits that with regard to the allegation of homicide in later part of FIR, there is a separate case in which the present accused has got bail. 5. Mr. D. P. Goswami, learned Additional Public Prosecutor submits that investigation is completed as per information, resulting in a charge-sheet. However, he has opposed granting bail at this stage. 6. Nevertheless, considering the completion of investigation and the length of detention – perhaps the accused can be allowed to go on bail at this stage. 7. Accordingly, it is provided that the accused petitioner, named above, shall be released on bail of Rs.30,000/- with one suitable surety of like amount to the satisfaction of learned concerned court subject to the following conditions that the petitioner: (a) shall be available for trial if one commence. (b) Shall not hamper or tamper with evidence. (c) shall not intimate or harass the informant or any witnesses. 8. Accordingly, this bail application stands allowed and disposed of.
