HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CIVIL REVISION No. - 18 of 2018 Court No. - 6 HON'BLE JASPREET SINGH, J. 1. Heard Sri Abdul Muqeem, learned counsel for the revisionist who submits that by means of the instant revision, the revisionist had challenged the removal of the Committee concerned. 2. On 12.03.2018, an interim order directing the parties to maintain status- quo was passed which still continues. 3. It has further been stated that the term of the Committee was for a period of three years which already has expired in the year 2020. 4. It is further urged that because of the interim order, the Board is also not proceeding despite applications for fresh constitution of the Committee are pending and in such circumstances, the revisionist does not wish to press the instant revision, as it has become infructuous with passage of time. 5. Sri Najam Zafar, learned counsel appearing for respondent nos. 3 to 13 does not dispute the fact that the term of the Committee has expired. 6. Sri Farhan Habib, learned Senior Counsel appearing for the respondent no. 1 and 2 has made a vary fantastic submission that even though they Versus Counsel for Revisionist(s) : Arshad Ahsan Siddiqui, Abdul Muqeem Counsel for Opposite Party(s) : Najam Zafar, Farhan Habib, Najam Zafar, Q.H.Rizvi, Rafat Farooqui, Zafar Yab Jilani C/M Waqf No.62 Raebareli Thru. Nafees Ahmad Khan And Anr. .....Revisionist(s) U.P. Sunni Central Waqf Board Thru. Chief Exec.Officer And Ors .....Opposite Party(s) have the applications for constitution of the fresh Committee as the term had expired in the year 2020 but because of the interim order subsisting in the revision they have been prevented from proceeding with the matter. 7. The submission of learned counsel for the Board apparently, is misconceived. It only indicates that the Board has been an ultimate failure in discharge of their duties, inasmuch as, once the term of the Committee had concluded in the year 2020, there has been no effort made by the Board to get any clarification, if at all, which was required, regarding the status of the term of the Committee which had expired in the year 2020 and no effort was made to get the case listed, thus, the submission appears to be completely motivated. 8. 8. Since the learned counsel for the revisionist does not wish to press the revision, accordingly, the present revision is dismissed as not pressed. The interim order, if any, stands discharged.
