05/ 01.09.2025: Heard learned counsel for the petitioner and learned counsel for the State.
2. The petitioner is apprehending his arrest in connection with Sadar P.S. Case No. 90 of 2025, registered under section 316(2) and 318(4) of BNS, 2023, pending in the Court of learned Chief Judicial Magistrate, Chatra.

Learned counsel for the petitioner submits that matter is arising out of civil dispute in view of the fact that a lease agreement has been entered into between the parties. He submits that 50% amount was to be deposited within six months and prior to that the petitioner requested the Deputy Development Commissioner-cum-Chief Executive Officer, Zila Parishad, Chatra to cancel the lease since the complete premises after repairing was not handed over to him and he also fell seriously ill and he had to go to Vellore for medical treatment. He submits that in view of that a legal notice has been sent for cancellation of lease. He submits that petitioner has paid 50% amount of Rs. 11,85,900/- and rest 50% amount of Rs. 11,85,900/- has not been paid. On these grounds, he submits that the petitioner may kindly be provided privilege of anticipatory bail.

Learned counsel for the State opposes the prayer and submits

It appears that matter is arising out of lease agreement and in terms of lease agreement Rs. 11,85,900/-has been deposited and remaining amount of Rs. 11,85,900/- has not been paid and the petitioner has already received notice under Section 35(3) of BNSS, 2023 and he has replied the same. In that view of the matter the petitioner is directed to surrender before the learned court within two weeks from the date of receipt/production of a copy of this order and the learned court shall release the petitioner on terms and conditions and sureties as learned court deems fit and proper.
6. This anticipatory bail application is disposed of.
