Neutral Citation No. - 2025:AHC:78500-DB Court No. - 42 Case :- CRIMINAL MISC. WRIT PETITION No. - 2795 of 2025 Petitioner :- Smt. Seenu Sengar Respondent :- State Of Uttar Pradesh And 6 Others Counsel for Petitioner :- Rohit Shukla Counsel for Respondent :- G.A. Hon'ble Mahesh Chandra Tripathi,J. Hon'ble Anil Kumar-X,J.
1. Heard learned counsel for the petitioner, learned AGA for the State- respondents and perused the record.
2. This writ petition is preferred praying for the following principal relief:
"i) issue a writ, order or direction in the nature of mandamus directing the respondent Nos.2 and 3 to transfer the investigation of Case Crime No.0381 of 2023, under sections 147, 406, 420, 452, 323, 354-B, 427, 506, IPC, Police Station Highway, District Mathura for fair investigation and conclude the investigation in the matter and submit the report under section 173(2) Cr.P.C. in accordance with law as expeditiously as possible."
3. Sri G. P. Singh, learned A.G.A.-1 for the State-respondents on the instructions states that in the instant matter initially the investigation was completed and final report was submitted before the competent court. Thereafter, on protest petition filed by the informant, further investigation was conducted by the investigating officer and later on final report was again submitted. As as such the writ petition has rendered itself as infructuous, as the cause for filing the writ petition no more survives and the same is liable to be dismissed.
4. Considering the categorical statement of learned A.G.A.-1 for the State- respondents, we are not inclined to proceed further in the matter. Needless to say, in case the petitioners is aggrieved with the submission of final report, it is always open to her to agitate before the appropriate forum.
5. Accordingly, the writ petition is disposed of. (Anil Kumar-X,J.) (Mahesh Chandra Tripathi,J.) Order Date :- 13.5.2025 VKG Digitally signed by :- VIJAY KUMAR GUPTA High Court of Judicature at Allahabad
