JUSTICE D.BHARATHA CHAKRAVARTHY Suo Motu TR.No.10790 of 2025 (S.C.No.60 of 2005 of Chief Judicial Magistrate, Ranipet Taluk, Ranipet) For Petitioner : Mr.S.Sugendran Additional Public Prosecutor ORDER This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu.W.P.(Crl.) No.618 of 2025. 2. This case in Cr.No.740 of 1998 is registered for the alleged offences under Sections 457 and 395 of Indian Penal Code, 1860. This occurence took place on 01.10.1998. 3. In respect of the other accused, the case has already been proceeded and some of the them have been convicted. However, it can be seen that S.C.No.60 of 2005 has been pending for more than 20 years and it has been 27 years from the time of occurence. Therefore, this Courts finds it to be a fit case to invoke its extraordinary power under Article 226 of the Consititution of India and under Section 482 of the Code of Criminal Procedure. Accordingly, the case in S.C.No.60 of 2005 on the file of the Chief Judicial Magistrate, Ranipet Taluk, Ranipet shall stand closed with liberty to the prosecution to reopen the case if any clue is obtained and the accused resurfaces again. 5. Accordingly, this Suo Motu Transfer Case stands disposed of. 26.09.2025 nsl Note to the Trial Court: This order is digitally signed and communicated electronically alone.
